THE ROOFER CHICK WEBSITE TERMS & CONDITIONS

Welcome to The Roofer Chick, your trusted service provider for all your roofing questions to help you get the roof you’re paying for, and to get the most out of your roof.  This website, www.therooferchick.com, and all associated goods and services and information available here (the “Resources”) is owned and operated by The Roofer Chick, Inc., a Florida corporation (collectively hereinafter, the “Website” and/or “RooferChick” and/or “Us” or “We”).  By accessing this Website other than to just read these Terms and Conditions, and/or using the Resources, or purchasing any of our goods and services available here, or otherwise interacting with us in any way, you understand and agree to these Terms and Conditions as stated in this policy (the “User Agreement”) along with all terms as set forth in our Privacy Policy (see below).

This User Agreement is effective as of 7/16/2023 and thereafter.  We reserve the right to modify this User Agreement without notice to you other than updating the effective date.  Your continued use of the Website or any of our services or information after a date as set forth here constitutes your continued agreement to this User Agreement.

We provide this Website and the Resources to offer you information, goods and services, and other tools as well as links to other sources of what We believe to be beneficial things.  However, each circumstance is unique and unless and until We and you enter into any specific contract for the provision of goods and/or services specific to your situation, the Resources are for educational and general information purposes only and are expressly provided “as-is” and without any warranty of fitness for any particular purpose or that the Resources will be available as and when you need.  You agree to use the Resources only for the purposes intended as permitted by this User Agreement or applicable law and agree to make your own independent evaluation of any particular Resource as being appropriate for your purposes.  We may provide some Resources in exchange for fees as set forth herein.  Some Resources are provided without charge.  In order to access any paid Resource, you will be required to set up an account or enter into a specific contract with Us for such Resource and you are responsible for all activity that occurs under your account.  Accessing (or attempting to access) any Resource by any means other than through the means We provide is strictly prohibited.  We believe the Resources will help you streamline any roofing issues which you are facing, including shopping for roof replacement or repair to interacting with insurance companies regarding your roof or anticipated roof replacement.

In order to access the Resources We provide, you may be required to schedule a call with Us to determine your particular needs, or set up an account with Us and authorize Us to charge you fees as We disclose to you as the charges for the goods and/or services We provide.  In doing so, you understand and agree:

  1. To pay Us any associated fees, if any, in connection with our charges as set forth and as ordered by you.
  2. All information you provide to Us (name, email, etc.) is accurate, correct, and up-to-date.
  3. You are responsible for maintaining the confidentiality of any passwords or other details of your account, for any member-only access to the Resources, if any (provided any such leak of information is not the result of a compromise of our website security).
  4. You will not engage in any activity that disrupts or interferes with our Website functionality or security, including the servers and/or networks through which the Resources are accessed.
  5. You will not copy, duplicate, reproduce, re-sell, trade, or otherwise violate any of our ownership interest in any of the Resources.
  6. You are solely liable for any consequences, damages, or other losses that we may directly or indirectly incur or suffer due to any prohibited activity on your part or perpetrated through your account.
  7. You will not solicit from anyone, or provide through your account, anything that is illegal or reasonably deemed offensive or immoral and you will not upload, post, share, or otherwise distribute any content that is illegal, threatening, defamatory, abusive, fraudulent, racist, or otherwise containing any inappropriate language or improperly impersonates any third-party or misappropriates any third-party owned material.
  8. We are not responsible for the acts or omissions of any third party with whom you have contact or otherwise interact through our Resources (unless We specifically provide for this in a written contract) and you alone are responsible to conduct your own due diligence in connection with any third party information provided to you.
  9. You agree to indemnify and hold harmless RooferChick and its affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.
  10. You understand and agree that any claim you may have against us is limited to the amount you paid, if any, for use of the Resources and Roofer Chick is not liable for any direct, indirect, incidental, consequential, or exemplary damages which may be incurred by you as a result of using the Resources to the full extent possible under applicable limitation of liability laws.
  11. All content and materials available through our Website, including but not limited to text, graphics, website name, brands, code, images and logos, and the Resources, are the intellectual property of RooferChick and are protected by applicable copyright and trademark law, as well as other applicable laws and statutes. Any inappropriate use, including but not limited to the reproduction, distribution, display, or transmission of any such content is strictly prohibited unless specifically authorized by Us in writing.
  12. You agree that We may, at our sole discretion, suspend or terminate your access to all or part of the Website, including any Resources, with or without notice and for any reason, including, without limitation, a breach of this User Agreement. Any suspected illegal, fraudulent, or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with Us, including any account or login information, if any.
  13. The Website and the Resources are controlled by RooferChick from our offices located in the state of Florida, USA. We realize the Website and the Resources may be accessed in most countries around the world.  As each country has laws that may differ from those of Florida or of the US, by accessing Our Website and/or any Resource, you agree that the statutes and laws of Florida, and of US federal law, as applicable, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of the Website and the purchase of any products or services through us.  Moreover, any action to enforce this User Agreement is to be brought in the federal or state courts located in Florida, US and you hereby agree to personal jurisdiction by such courts and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
  14. UNLESS OTHERWISE EXPRESSED IN WRITING AS TO ANY SPECIFIC RESOURCE OR OTHER MATERIAL, ROOFERCHICK EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

  • RooferChick provides tools and information directly on Our Website at no charge and offers additional paid services and the opportunity to purchase certain goods we believe to be good and reliable in the roofing industry. We make no general guarantees about any of the foregoing but may offer specific guarantees in connection with specific purchases.  We may also pass along to you a manufacturer guarantee in connection with any goods available.  Other than as expressly stated to you, you should not assume there is any guarantee, and everything is otherwise provided on an “as-is” basis for informational and educational purposes only.
  • Roofer Chick may display curated exclusive offers for you on Our Website.
  • RooferChick may add additional functionality in the future which may be automatically be encompassed under the Resources.
  • . RooferChick may have links and/or resources listed/or mentioned and makes no guarantee of these listed and/or mentioned on this site.
  • RooferChick makes no endorsement of other products and/or services.

REFUND POLICY

EXCEPT AS SET FORTH IN THIS SECTION, ALL SALES ARE FINAL.

We care about each of our customers and clients and want you to be 100% satisfied with your RooferChick experience. In the rare event, that you are not satisfied, RooferChick will issue a refund in its sole and absolute discretion that We believe is fair based on the goods, services, and/or other Resources obtained and utilized by you.  We may offer an exchange of goods or a repeat of services in lieu of any refund.

To receive a refund, either in full or partial, you must contact us at asktherooferchick@gmail.com.  All refund decisions, refund amounts, and refund scenarios are at the sole discretion of RooferChick.

Products and/or services received directly from other than The RooferChick must be sought after first by that company and/or person the items or services issued from.

All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway provider’s database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.  We are GDRP compliant.

We may provide third-party vendors with aggregated, encrypted and de-identified data that is not capable of personally identifying any specific individual.  We may provide your Personal Information when we believe release is appropriate to comply with the law, enforce Our Website policies, or protect our or others’ rights, property, or safety.  

RooferChick will only use your Personal Information for the purposes described in this Privacy Policy or as subsequently authorized by you. You may opt out of this Privacy Policy at any time by providing us with written notice and terminating your account.  When we receive such a notice, subject to our prior legal and contractual restrictions, of which we will advise you, if any, and subject to a reasonable timeframe within which to accomplish the task, we will terminate your access to the Resources, delete your profile and all stored Personal Information.  Any act on our part prior to the receipt of such a notice is subject to this Privacy Policy.  We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), and as such, we do not knowingly collect any information from anyone under 13 years of age.  The Website and the Resources are all directed to people who are at least 13 years old or older.  We have taken precautions to ensure that we are compliant with the CAN-SPAM Act of 2003 by never knowingly sending out misleading information.
